County Ordinance – Adjacent Right-of-Way Maintenance Code

SARASOTA COUNTY ORDINANCE
AFFECTING DESOTO ACRES RESIDENTS

EFFECTIVE OCT 1, 2016

ADJACENT RIGHT-OF-WAY MAINTENANCE CODE
Ordinance No. 2016-058, adopted 8/24/2016

This is to notify our DeSoto Acres residents of the County Ordinance that, except for the roads listed below, all DeSoto Acres Residents will be responsible for the Right-Of-Way (ROW) adjacent to your property. That means mowing the grassed or vegetated area, cleaning-up the cut vegetation and removing trash, debris and litter from the ROW.

The Residents’ properties adjacent to Lockwood Ridge Rd, Tuttle Ave, and DeSoto Rd are not affected as these are designated collector and arterial roads. The County will continue to mow the ROW along these roads.

If you are affected, the County is putting in place an Administrative Appeal process to review if your property can continue to receive the County mowing service. Each property Owner must submit the application for review. Contact the County at 861-5000 to request a Right-of-Way appeal.

This is a County driven Ordinance. The County held three advertised public workshops to get the community’s input. The Commissioners approved the Ordinance 4-1 at a public hearing on 8/24/2016.
